Logan resident Rocky Rivera, 32, was arrested Sunday on charges of attempted murder — a first-degree felony — aggravated assault, possession of a firearm by a restricted person and felony discharge of a firearm, all third-degree felonies.
According to the probable cause affidavit, Rivera allegedly stabbed someone in the arm and fired a gun at the person during a dispute.
Rivera’s initial court appearance is set for Monday. According to the Cache County Sheriff’s Office, Rivera’s bail was set at $50,000.
According to the affidavit, Logan Police responded to a call about a dispute on Nov. 16 at Rivera’s residence. The caller said two individuals were shooting at each other.
After arriving and interviewing Rivera, police found he had two stab wounds in his shoulder. Rivera was transported to Logan Regional Hospital for further evaluation.
Officers located a spent pistol cartridge and a black knife on the sidewalk and grassy area in front of the residence, according to the affidavit.
Information from family members led Logan Police to take two people into custody, a woman who shares a child with Rivera and her male cousin.
According to the affidavit, in an interview with police, the male said his cousin asked him to drive her to Rivera’s residence to pick up Rivera and her child. They attempted to do so twice.
The first time, Rivera came out and stabbed the man in the arm and hand repeatedly until they drove away.
The man and his cousin later returned to try to pick up the child again. According to the affidavit, the man said when they arrived, the child came and got into the vehicle. Rivera then came out of the residence with a pistol and shot into the ground. The man said Rivera then pointed the gun at him saying, “I’m going to kill you,” and fired the firearm a second time, but missed him.
The two got into a physical altercation in which the man may have stabbed Rivera.
According to the affidavit, the male had a deep cut on his left hand that would be consistent with a defensive wound and a superficial stab wound on his left arm. The male also had a thick black jacket on that had several puncture holes on the left sleeve of the jacket.
The female was also interviewed, her story was consistent with the male cousin’s story.
Rivera was released from the hospital and was taken into custody.
After obtaining a search warrant, police searched Rivera’s residence and found a large amount of blood and a holster for a pistol. Police reviewed footage from a doorbell camera, which seemed to support the male and female cousins’ stories.
According to the affidavit, Rivera had previously been convicted of felony charges and should not have had a firearm.
Rivera’s initial court appearance is set for Monday. According to the Cache County Sheriff’s Office, Rivera was assigned bail of $50,000.
